VIOLOENCE AGAINST PERSONS PROHIBITION LAW

As part of our commitment to advocacy and education, we believe it is important to understand the legal framework that addresses sexual violence in Nigeria. One significant legislation in this regard is the Violence Against Persons Prohibition (VAPP) Law. This page aims to clarify the key aspects of the VAPP Law and its implications in the fight against sexual violence.

Understanding the VAPP Law: The Violence Against Persons Prohibition (VAPP) Law is a landmark legislation enacted in Nigeria to address various forms of violence, including sexual violence, domestic violence, harmful traditional practices and more. It was enacted in 2015 to provide a comprehensive legal framework for the prevention and prohibition of these acts, as well as the protection and support of victims.

Key Provisions:

  1. Definition of Offenses: The VAPP Law categorically defines various forms of violence, including rape, sexual assault, domestic violence, harmful traditional practices and more. This clarity is important for legal proceedings and ensures that perpetrators can be held accountable for their actions.
  2. Penalties and Punishments: The law stipulates severe penalties for offenders, including lengthy prison sentences and fines, depending on the severity of the offence. These deterrents aim to discourage individuals from engaging in acts of violence and provide justice for survivors.
  3. Protection Measures: One of the significant aspects of the VAPP Law is the provision of protection measures for survivors. This includes restraining orders, shelter, medical assistance, counselling services and other forms of support to ensure the safety and well-being of survivors as they navigate the legal process.
  4. Legal Procedures and Support: The law outlines legal procedures for reporting, investigation and prosecution of cases related to violence against persons. It also emphasises the importance of support services for survivors, including legal aid, counselling and victim advocacy, to facilitate their journey towards justice and healing.

Impact and Challenges:

While the VAPP Law represents a significant step forward in addressing sexual violence in Nigeria, its effective implementation still faces various challenges. These challenges may include inadequate awareness of the law, insufficient resources for law enforcement and support services, cultural barriers and societal stigmatisation of survivors. STER continues to work towards overcoming these challenges through advocacy, capacity building, creation of training manuals and community engagement initiatives.
